Statement From Commissioner Patrick Hooker
Regarding the Meadowsweet Dairy vs. the Department
"In a decision received this week, New York State Supreme Court, Albany County, acknowledged the Department’s broad authority over the production, processing and distribution of food and dairy products, and in this case, raw milk.
"In the case brought by Meadowsweet Dairy, LLC against the New York State Department of Agriculture and Markets, the Court also affirmed the Department’s clear authority to inspect Meadowsweet’s premises and products, and to require that Meadowsweet hold appropriate permits issued by the Commissioner.
"The Department remains dedicated to administering and enforcing the State’s food safety laws and regulations to protect the public health and help assure that consumers have access to wholesome and nutritious food and dairy products."
